Terms and Conditions

All payments are due NET 30 DAYS FROM DATE OF INVOICE with approved credit, unless otherwise agreed upon in writing. All invoices are due and payable in US dollars.

All prices are subject to change without notice. All prices are Ex-works, our warehouse in Muenster, Texas, USA, unless otherwise stated. Export packing, freight, forwarding and handling, and other freight-related charges are at Purchaser’s expense.

If no preferred method of shipment is stated, we will make every effort to ship by the most economical method. Receipt of product by the designated carrier ends Koch Sales Company’s liability. CLAIMS FOR DELAY, LOSS OR DAMAGE ARE TO BE MADE AGAINST THE CARRIER.

Backorders will remain in effect until canceled by Purchaser and will be shipped at the earliest possible date.

All special orders are non-cancellable and non-returnable. Koch Sales has the right to require prepayment from Purchaser as deemed necessary.

As a distributor of automotive parts, Koch Sales Company is not liable for parts distributed by Koch (from Manufacturer.) Koch passes on all warranties given by the Supplier/Manufacturer to Purchaser. All products sold are subject to the original manufacturer’s warranty specifications and guidelines. Koch Sales will act as intermediary for the Purchaser in the process of returning parts to the Manufacturer for refund, repair, exchange or credit, depending on the warranty policy of the manufacturer.

All returned compressors, accumulators, and driers must be capped. No open or disassembled compressors will be accepted. Koch Sales Company will forward all returned product to the Manufacturer for inspection and approval or denial of warranty claim. All warranty parts must be shipped FREIGHT PREPAID. Koch makes no agreement, nor authorizes any third-party to agree, to payment of labor or other costs incurred in connection with the defective part.

All returns must be approved by Koch Sales Company in writing before return. All returns must be sent FREIGHT PREPAID and must be packaged to prevent damage in transit. All returns are subject to a 15% restocking charge. No returns will be accepted until they have been inspected and approved. Koch does not offer cash or check reimbursement for returned merchandise. Purchaser shall not deduct amounts for returned products from any payments owed. No credit will be made until a credit memo is issued.

Under no circumstances will Koch Sales Company be held responsible for rework, labor or warranty costs incurred by the purchaser, regardless of the reason.

Koch Sales Company assumes no liability for damage, losses or injuries, direct or other wise, that may arise from Purchaser’s or any third party’s use or inability to use any of the products sold by Koch. Purchaser agrees to indemnify and hold Koch Sales Company harmless of any claim, judgment, award, order, or decree that might be rendered in such suit or proceeding. Purchaser agrees to pay all expenses and fees of counsel in such suits or proceedings.
